Terms & Conditions

Preamble:

These Terms and Conditions constitute the agreement between the Platform, the User, and the Service Provider. They outline the terms and conditions of the Platform, as well as clarify the provisions for using and benefiting from the Platform, including the obligations and rights of each party. This Terms and Conditions Agreement has been added to the Platform’s homepage to ensure easy access and review. By visiting the Platform, using it, or creating a personal account on the Platform, you agree to this Terms and Conditions Agreement.

Definitions:

Platform: Refers to both the LaFeeF.co website and the LaFeeF.co mobile application, which provide a mediation service between the Service Provider and the User by displaying the Service Provider’s products on the Platform and enabling the User to purchase or benefit from these products.

User: Refers to any individual who visits or uses the Platform or creates a personal account on the Platform for the purpose of purchasing or benefiting from the products.

Service Provider: Refers to any individual or entity that offers bookings, tickets, services, or other activities and offers on the Platform for the purpose of sale.

Products: Refers to all tickets, bookings, services, and other activities and offers available on the Platform.

Product Specifications: Refers to information related to the products, such as prices, purchase conditions, location, and time of product collection or utilization.

Data: Refers to the information entered by the User on the Platform for the purpose of creating a personal account or purchasing any of the products.

Terms and Conditions of Use:

1- The User and the Service Provider each commit to complying with all applicable laws and regulations while using the Platform.

2- It is prohibited to use the Platform for any illegal purposes or for purposes that conflict with the provisions of this Terms and Conditions Agreement.

3- The Platform disclaims any responsibility for any errors in the data or product specifications, or for their inaccuracy or conflict with any current laws or those that may be imposed in the future.

4- Product specifications may be modified at any time, and it is the User's responsibility to verify the product specifications before making a purchase.

5- The Service Provider may cancel the purpose of the product, its delivery, or its use at any time before the event or the scheduled time of use, such as canceling a show or concert for reasons specific to the Service Provider. In such cases, the Platform shall not be held responsible for any consequences resulting from this cancellation. The Platform will attempt to notify the User of the cancellation as soon as it becomes aware of it.

6- In the event of any issues or claims related to the product or its use, the User must directly contact the Service Provider for all matters related to such issues or claims.

7- The Platform does not guarantee refunds after purchase and is not obligated to accept returns of products after they have been purchased.

8- The Platform continuously updates these Terms and Conditions of Use. It is the User's responsibility to review these Terms and Conditions and comply with any modifications. Any updates to these Terms and Conditions shall become effective from the date they are published on the Platform.

9- If any provision of these Terms and Conditions conflicts with any laws or regulations, or is unenforceable, the remaining provisions shall remain in full force and effect.

10- Neither the User nor the Service Provider has the right to transfer the obligations listed in these Terms and Conditions without obtaining prior written consent from the Platform. The Platform reserves the right to assign or transfer these Terms and Conditions to any third party without any restrictions.

Platform Rights and Obligations:

1- The Platform is committed to making every effort to ensure the readiness, effectiveness, and quality of its performance. However, it does not guarantee the absence of any unexpected interruptions resulting from updates, maintenance, or unforeseen technical issues.

2- The Platform reserves the right to modify, suspend, or terminate the Platform or any of its features at any time, without prior notice or liability.

3- The Platform strives to satisfy both Users and Service Providers and, to this end, contracts with third-party service providers, such as payment processors, to facilitate the services provided on the Platform. The Platform is not responsible for any errors, negligence, or claims arising from the services provided by third parties.

4- The Platform has the right to amend, develop, and enhance the Platform and its terms and conditions. By continuing to use the Platform after any changes to the Platform or the Terms and Conditions Agreement, the User acknowledges acceptance of all updated terms and conditions.

5-The Platform is committed to protecting the privacy and security of Users' and Service Providers' personal data and information. However, it reserves the right to use any data, statistics, or information for auditing, research, and development purposes.

6-The Platform is responsible for publishing information and product specifications as received from the Service Provider and disclaims any responsibility for inaccuracies, errors, or incorrectness in such information.

7-The Platform continuously works on improving and developing the Platform to achieve benefits for all parties involved.

User Rights and Obligations:

1- The User acknowledges that they are legally competent and of legal age. They are obligated to create a genuine, non-programmed personal account on the Platform solely for personal use. The User's personal account must contain accurate and truthful information without any distortion or incorrect entries to complete the product purchase and payment procedures. The product cannot be purchased or used until a genuine User account is created.

2- The User must create only one personal account for reservations and purchases for personal use, not for commercial purposes or resale on any platforms not affiliated with this Platform. The User acknowledges that using the Platform for commercial purposes or resale on non-affiliated platforms may lead to legal action and grants the Platform the right to cancel the product without refund and to block or close their account and its contents. The User must ensure that all data entered and registered in their account is accurate and up-to-date, including contact and payment information, before, during, and after the purchase or use of the product.

3- The User is responsible for maintaining the confidentiality of their account information and must ensure that no unauthorized person accesses their account or performs any transactions. If another user accesses the account, they will be treated as the primary user, and all actions performed will be considered valid. The User must notify the Platform immediately upon becoming aware of any unauthorized access. The Platform is not responsible for any changes or actions taken on the User’s account.

4- By attending events, activities, or trials advertised on the Platform, the User grants the Platform, the Service Provider, organizers, their partners, and sponsors a non-exclusive, royalty-free, perpetual, and worldwide license to photograph the User and their companions, and to use, copy, distribute, display, and modify these images for promotional, marketing, and other purposes. The User acknowledges that the Platform is not responsible for any consequences arising from the photography, use of images, or any liabilities related to the use of these images or videos.

5- The User agrees to comply with and not violate any applicable laws, regulations, decisions, rules, terms, and guidelines related to the Platform, including those concerning reservations, purchases, event attendance, trials, or other activities. The User acknowledges that their use of the Platform is in compliance with the laws and regulations and this Terms and Conditions Agreement, as well as the Service Provider’s terms and conditions, and does not conflict with any of these in any way.

6- The User authorizes the payment gateway (the entity responsible for processing payments) and the Platform to deduct the ticket value through the payment method selected by them, using the credit card information provided by the User for processing the payment. The User is responsible for any fees arising from this payment process.

7- The User agrees not to engage in any actions that conflict with these obligations, or commit any fraudulent activities or acts that could harm the Platform or the merchant. If the User breaches or violates any of these obligations, their account may be suspended or terminated. In such cases, the User is not entitled to request, appeal, or file a complaint to any entity at any time to restore their account or its contents. The Platform reserves the right to pursue legal and judicial action.

8- The User must not engage in any behavior that may obstruct or damage the Platform's operations, interfere with other users' access to the Platform, or harm the Platform’s privacy, integrity, and security.

9- If the User is using the Platform from outside the Kingdom of Saudi Arabia, they acknowledge the Platform's disclaimer of responsibility for any consequences arising from the use of the Platform. The User does not have the right to request refunds or compensation related to the use of the Platform or dealings with it. The Platform does not guarantee the refund of amounts paid for purchasing or using a product.

10- The User agrees not to use the Platform for illegal, harmful, or malicious purposes, including but not limited to sending viruses or malicious software, unauthorized access, or data manipulation.

11- The User agrees to assume full responsibility and indemnify the Platform against any claims, damages, losses, or liabilities arising from the use of the Platform.

Intellectual Property Rights:

1- The Platform retains all intellectual property rights. In the event of any exploitation, modification, or use of the Platform’s intellectual property rights, either directly or indirectly, the Platform reserves the right to take any action it deems appropriate to stop such exploitation, modification, or use and to seek compensation for it.

2- All content on the Platform, including but not limited to codes, visible or written data, the trade name, and the trademark, are the property of the Platform and may not be exploited or used in any manner.

3- Neither the User nor the Service Provider is entitled, under any circumstances, to exploit or use, directly or indirectly, any of the Platform’s registered or unregistered intellectual property rights, including but not limited to artistic designs, technical designs, programming languages, or logos.

4- All data, codes, images, electronic designs, content, trademarks, appearance, and other elements, whether registered or unregistered, domestically or internationally, are exclusively owned by the Platform. No other party has the right to use or benefit from them.

5- No entity or individual is permitted to monitor, copy, derive ideas from, download, reproduce, or use any content displayed on the Platform for any purpose without obtaining written permission from the Platform.

6- The Platform may allow the User or Service Provider to submit or post content, including but not limited to reviews, ratings, comments, or other materials. By agreeing to this Terms and Conditions Agreement, you grant the Platform a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content on the Platform or use it for research and development purposes.

7- The User warrants that they own the necessary rights to the content they submit and that such content does not infringe upon the intellectual property rights or any other rights of any third party.

8- The Platform reserves the right to remove or modify any User or Service Provider content that violates these terms or is deemed inappropriate at the Platform's sole discretion.

9- The Platform may contain links to third-party websites and resources. These links are provided to enhance user experience and convenience. The Platform does not endorse or encourage engagement with these third-party sites and assumes no responsibility for the content, products, or services provided by third parties. The User's interactions with third-party websites are unrelated to the Platform, and the Platform bears no responsibility for any outcomes or for any terms, conditions, or privacy policies governing those third-party websites, which are separate and independent from the Platform’s Terms and Conditions.

Disputes and Governing Law:

This Terms and Conditions Agreement shall be governed by and construed in accordance with the regulations, laws, and decisions of the competent authorities in the Kingdom of Saudi Arabia. In the event of any dispute arising between the parties to this Terms and Conditions Agreement, an attempt shall be made to resolve the dispute amicably through written notices between the parties. If an amicable resolution cannot be reached, the parties shall have the right to seek recourse through the competent judicial authorities in Jeddah, Kingdom of Saudi Arabia.

الشروط الأحكام

التمهيد:

هذه الشروط والأحكام تشكل الاتفاق بين المنصة والمستخدم ومقدم الخدمة وتحتوي على الشروط والأحكام للمنصة، كما توضح بنود استخدام المنصة والاستفادة منها والتزامات وحقوق كل طرف. تم إضافة اتفاقية الشروط والأحكام هذه للصفحة الرئيسية للمنصة لضمان سهولة الوصول والاطلاع عليها، وفي حال زيارة المنصة أو استخدامها أو إنشاء حساب شخصي على المنصة يعني الموافقة على اتفاقية الشروط والأحكام هذه.

التعريفات:

المنصة: تشير إلى كل من موقع لفيف - LaFeeF.co الإلكتروني وتطبيق  لفيف - LaFeeF.co الإلكتروني، والذي يقوم بتقديم خدمة الوساطة بين مقدم الخدمة والمستخدم، عن طريق عرض منتجات مقدم الخدمة على المنصة وتمكين المستخدم من شراء المنتجات أو الانتفاع منها. 

المستخدم: هو كل من يقوم بزيارة أو استخدام المنصة، أو إنشاء حساب شخصي في المنصة لغرض شراء المنتجات أو الانتفاع منها.

مقدم الخدمة: كل من يقوم بعرض الحجوزات والتذاكر والخدمات وغيره من الأنشطة والعروض على المنصة لغرض البيع.

المنتجات: تعني كل من التذاكر والحجوزات والخدمات وغيره من الأنشطة والعروض المتوفرة على المنصة.

مواصفات المنتج: تشير إلى المعلومات المتعلق بالمنتجات من أسعار، أو شروط شراء، أو موقع وموعد استلام المنتج أو الانتفاع منه.

البيانات: تشير إلى المعلومات التي يقوم المستخدم بإدخالها على المنصة لإنشاء حساب شخصي أو شراء أي من المنتجات.

شروط واحكام الاستخدام:

١ - يتعهد كل من المستخدم ومقدم الخدمة في حين استخدام المنصة بالالتزام بالأنظمة والقوانين ذات العلاقة.

٢- يحظر استخدام المنصة لأي من الاغراض الغير قانونية أو التي تتعارض مع بنود اتفاقية الشروط والأحكام هذه.

٣-  تُخلي المنصة مسؤوليتها عن أي خطأ في البيانات ومواصفات المنتج أو عدم دقتها أو تعارضها مع أي من القوانين الحالية أو التي قد يتم فرضها مستقبلاً.

٤- قد يتم التعديل على مواصفات المنتج في أي وقت، ويكون المستخدم مسؤولاً عن التأكد من مواصفات المنتج قبل الشراء.

٥- قد يقوم مقدم الخدمة بإلغاء الغرض من المنتج أو تسليمه أو الانتفاع منه في أي وقت قبل الحدث أو موعد الانتفاع من المنتج، مثل إلغاء العرض أو الحفل لأسباب خاصة بمقدم الخدمة، وفي هذه الحالة لا تكون المنصة مسؤولة عن أي مما ينتج عن هذا الإلغاء، كما ستقوم المنصة بمحاولة إبلاغ المستخدم بهذا الإلغاء فور علمها بذلك. 

٦- في حال وجود أي من الإشكاليات أو المطالبات المتعلقة بالمنتج أو الانتفاع منه فيجب على المستخدم التواصل مع مقدم الخدمة مباشرة لكل ما هو له علاقة بـ الإشكاليات أو المطالبات.

٧- المنصة لا تضمن عملية استرداد الأموال بعد الشراء، ولا تكون ملزمة بإعادة المنتجات بعد شرائها.  

٨- تقوم المنصة بتحديث اتفاقية الشروط والاستخدام هذه بشكل مستمر، ويكون المستخدم مسؤولاً عن الإطلاع على اتفاقية الشروط والأحكام هذه والالتزام بما فيه وما يطرأ عليها من تعديلات، ويعتبر أي تحديث على اتفاقية الشروط والأحكام هذه سارياً من تاريخ نشره على المنصة.

٩- في حال وجود أي بند من بنود هذه الشروط والأحكام  يتعارض مع أي من الأنظمة والقوانين أو لا يمكن تنفيذه، فإن الأحكام الباقية ستظل سارية وفعّالة بكاملها.

١٠- لا يحق للمستخدم أو مقدم الخدمة تحويل الالتزامات المدرجة في هذه الشروط والأحكام دون الحصول على موافقة المنصة الكتابية المسبقة، كما تحتفظ المنصة بحقها في تخصيص أو نقل هذه الشروط إلى أي طرف ثالث دون أي قيود.

التزامات وحقوق المنصة:

١ - تلتزم المنصة ببذل الجهود الممكنة لضمان جاهزية وفاعلية أداء المنصة وجودتها، لكن لا تضمن عدم وجود أي انقطاعات مفاجئة ناتجة عن التحديثات او عمليات الصيانة أو المشاكل التقنية الغير متوقعة.

٢- تحتفظ المنصة بالحق في تعديل أو تعليق أو إنهاء المنصة أو أي من ميزاتها في أي وقت، دون إشعار مسبق أو مسؤولية.

٣- تقوم المنصة على العمل لإرضاء المستخدم ومقدم الخدمة ومن أجل ذلك تقوم المنصة بالتعاقد مع مقدمي خدمات من طرف ثالث، ومنهم على سبيل المثال وليس الحصر معالجي الدفع، لتسهيل الخدمات المقدمة على المنصة، ولا تتحمل المنصة أي من الأخطاء أو الإهمال أو المطالبات الناتجة عن كل ما يتم تقديمه من قبل الطرف الثالث.

٤- يحق للمنصة التعديل والتطوير والتحسين على المنصة وعلى الشروط والأحكام، ومن خلال استمرار المستخدم في استخدام المنصة بعد أي تعديلات على المنصة أو على اتفاقية الشروط والأحكام للمنصة، فإنه يُقر بقبول جميع الشروط والأحكام المحدثة.

٥- تلتزم المنصة ببذل الجهد لحماية خصوصية وأمان البيانات والمعلومات الشخصية للمستخدم ومقدم الخدمة، مع حقها باستخدام أي من البيانات والإحصاءات والمعلومات لأغراض التدقيق أو البحث والتطوير.

٦- تلتزم المنصة بنشر المعلومات ومواصفات المنتج كما تم استلامها من مقدم الخدمة، وتُخلي مسؤوليتها عن عدم الصحة أو الدقة أو الخطأ فيها.

٧- تقوم المنصة بالعمل المستمر على تحسين المنصة وتطويرها بما يحقق النفع والفائدة لجميع الأطراف.

التزامات وحقوق المستخدم:

١- يقر المستخدم بأنه يملك الأهلية النظامية وأنه وفق السن القانوني، ويلتزم بإنشاء حساب مستخدم حقيقي وغير مبرمج للاستخدام الشخصي فقط على المنصة، على أن يحتوي حساب المستخدم الشخصي على معلومات المستخدم الحقيقية والصحيحة دون أي تحريف أو إدخال معلومات غير صحيحة، وذلك حتى يتمكن من إكمال إجراءات شراء المنتج والدفع، في حين أنه لا يمكن شراء المنتج أو الانتفاع منه إلا بعد إنشاء حساب مستخدم حقيقي.

٢- يقوم المستخدم بإنشاء حساب شخصي واحد فقط للحجز والشراء لأغراض خاصة وليس لغرض المتاجرة وإعادة البيع على أي من المنصات الغير تابعة لهذه المنصة، مع إقراره بأن استخدام المنصة والشراء منها لغرض المتاجرة أو إعادة البيع على المنصات الغير تابعة لهذه المنصة يعرضه للمسائلة القانونية وإعطاء الحق للمنصة بإلغاء المنتج دون إعادة قيمته وحجب وإقفال حسابه وما يحتوي عليه، وبأن جميع البيانات المدخلة والمسجلة من قبله في حساب المستخدم هي معلوماته الصحيحة والمحدثة، وأن هذه المعلومات لا يشوبها أي خطأ أو تحريف بما فيها معلومات التواصل والدفع وذلك قبل وأثناء وبعد شراء المنتج أو الانتفاع منه.

٣- على المستخدم الحفاظ على سرية معلومات حساب المستخدم التابع له، والحفاظ على عدم السماح لأي شخص غيره بالدخول إلى الحساب وإجراء أي من العمليات، وفي حال دخول أي مستخدم آخر لحساب المستخدم غير المستفيد الحقيقي منه فإنه يعامل معاملة المستخدم الأساسي وتكون جميع العمليات والإجراءات التي قام بها صحيحة، ويلتزم المستخدم بإخطار المنصة مباشرة في حين علمه عن أي دخول غير مصرح به، ولا تكون المنصة في أي حال من الأحوال مسؤولة عن أي من التغيرات أو الإجراءات التي تمت على حساب المستخدم.

٤- من خلال حضور المستخدم للفعاليات أو الأنشطة أو التجارب المعروض عنها في المنصة، فإنه يمنح المنصة ومقدم الخدمة والمنظمين وشركاؤهم ورعاتهم ترخيصًا غير حصري وخالياً من الحقوق ودائم وعالمي لتصويره وحده ومن معه وإستخدام ونسخ وتوزيع وعرض وتعديل الصور لأغراض الترويج والتسويق وغيرها، كما يُقر المستخدم بعلمه بأن المنصة غير مسؤولة عن أي ما ينتج من عملية التصوير أو استخدام الصور أو أي مسؤولية عن أي ضرر أو خسارة تنشأ عن استخدام الصور أو المقاطع المرئية.

٥- يلتزم المستخدم عند زيارته للمنصة أو الاستخدام بالامتثال وعدم مخالفة أي من الأنظمة والقوانين والقرارات واللوائح والشروط والإرشادات ذات العلاقة، بما في ذلك تلك المتعلقة بالحجز، أو الشراء، أو حضور الفعاليات والتجارب، أو أي أنشطة أخرى. كما يقر ويلتزم المستخدم بأن استخدامه للمنصة متوافق مع القوانين والأنظمة، ومع اتفاقية الشروط والأحكام للمنصة، وشروط وأحكام مقدم الخدمة، ولا يتعارض مع أي من ذلك بأي شكلٍ من الأشكال.

٦- يعطي المستخدم الحق لبوابة الدفع (وهي الجهة التي تقوم بعملية استقبال المدفوعات ومعالجتها.) والحق للمنصة بخصم قيمة التذكرة عن طريقة آلية الدفع المختارة من قبله، وباستخدام معلومات البطاقة البنكية المدخلة من المستخدم لمعالجة عملية الدفع، كما يتحمل كل ما ينتج عن هذه العملية من رسوم لاتمام عملية الدفع. 

٧- يقر ويلتزم المستخدم بأن لا يقوم بأي عمل أو إجراء يتعارض مع هذه الالتزامات أو القيام بأي عمل احتيالي أو أي عمل قد تتضرر منه المنصة أو التاجر، وفي حال مخالفة ذلك او انتهاك أي من هذه الالتزامات فإن المستخدم يعرض حسابه إلى التعليق أو الإغلاق أو الإنهاء بشكل كامل، وفي حال تعليق أو إنهاء وإغلاق الحساب فلا يحق للمستخدم المطالبة أو التظلم أو تقديم شكوى أمام أي جهة كانت وفي أي وقتٍ كان لإستعادة الحساب أو ما يحتوي من أرصدة ومبيع لمخالفة أي من الالتزامات سابقة الذكر أو القيام بأي عمل احتيالي أو أي عمل قد تتضرر منه المنصة أو أي مقدم خدمة، وعليه تحتفظ المنصة بحقها بالمطالبة القانونية والقضائية.

٨- يلتزم المستخدم بعدم ممارسة أي سلوك قد يؤدي إلى الإعاقة أو الإضرار بعمليات المنصة، أو التدخل أو الإضرار بوصول المستخدمين الآخرين للمنصة، أو الاضرار بخصوصية ونزاهة وامان المنصة.

٩- في حال أن كان المستخدم يقوم باستخدام المنصة من خارج المملكة العربية السعودية فإنه يُقر بإخلاء مسؤولية المنصة عن كل ما ينتج من استخدام المنصة، ولا يحق له مطالبة المنصة باستعادة أي مبالغ أو تعويضات عن كل ما له علاقة من استخدام المنصة أو التعامل معها، ولا تضمن المنصة إعادة المبالغ المدفوعة لشراء منتج أو الانتفاع منه.

١٠- يلتزم المستخدم بعدم استخدام المنصة لأغراض غير قانونية أو ضارة أو نوايا غير حسنة، ويتضمن ذلك على سبيل المثال وليس الحصر إرسال الفيروسات أو البرامج الضارة، أو القيام بالوصول غير المصرَّح به أو التلاعب بالبيانات.

١١- يقر المستخدم بموافقته والتزامه بتحمل المسؤولية الكاملة وإخلاء مسؤولية المنصة عن أية مطالبات أو أضرار أو خسائر أو مسؤوليات تنشأ عن استخدام المنصة.

حقوق الملكیة:

١- تحتفظ المنصة بجميع حقوق الملكية الفكرية، وفي حال أي استغلال أو تعديل أو استخدام لحقوق الملكية الفكرية للمنصة بشكل مباشر أو غير مباشر، فيكون الحق للمنصة باتخاذ كل ما تراه مناسباً لوقف هذا الاستغلال أو التعديل أو الاستخدام والتعويض عنه.

٢- كل ما تحتوي عليه المنصة من رموز وبيانات مرئية أو مكتوبة بالإضافة إلى الاسم التجاري والعلامة التجارية هي حقوق للمنصة لا يمكن استغلالها أو استخدامها بأي شكلٍ من الأشكال.

٣- لا يحق للمستخدم أو مقدم الخدمة في أي حالٍ من الأحوال الاستغلال أو الاستخدام المباشر أو غير المباشر لأي من حقوق الملكية الفكرية المسجلة والغير مسجلة للمنصة، ومنها على سبيل المثال لا الحصر التصاميم الفنية أو التصاميم التقنية أو اللغات البرمجية أو الشعارات.  

٤- جميع البيانات والرموز والصور والتصاميم الإلكترونية والمحتوى والعلامات التجارية والشكل والمظهر وغيرها المسجل منها والغير مسجل داخلياً أو دولياً، هي جميعها حقوق مملوكة بواسطة المنصة وحدها ولا يحق لغيرها الاستخدام أو الاستفادة منها.
